Abstract: If any defendant is found mentally incompetent, the trial or judgment shall be suspended until the person becomes mentally competent. The whole process begins with a competency evaluation, assessing whether or not the individual is competent to stand trial for the charges brought against them. Once evaluated and found incompetent, the individual must be restored to competency in order to participate in their trial proceedings
